PROTECTION
Yes, generally. Foreign individuals and companies can acquire registered real estate under substantially the same property-registration framework used by Dominican buyers. A local partner is not normally required, and title can be held directly in your name or through an appropriate entity.Investor move: Confirm that the asset is individually titled and that the exact seller shown in the contract matches the registered owner.
Not simply to own property. Residency and citizenship are separate from ownership. A local bank account is not always legally necessary for the purchase, but banks, developers, tax authorities and the Title Registry may require identification, tax registration and detailed know-your-customer documentation. Expect to provide a valid passport, a second identification document, proof of address, marital status information and evidence showing where the purchase funds came from. Requirements vary by transaction and institution.
Often, yes. A buyer may authorize a Dominican attorney or another trusted representative through a power of attorney. Documents signed abroad commonly need notarization, apostille or consular legalization, and a Spanish translation by an authorized translator before use in the Dominican Republic.Do not use a generic power of attorney. Limit its scope, property, permitted actions, payment authority and expiration date. Your Dominican attorney should prepare or approve it before you sign abroad.
Yes - use counsel who represents only you. The seller's or developer's lawyer protects that party. Your attorney should confirm ownership, review the contract, investigate liens and restrictions, verify tax and association status, coordinate the notarized sale documents, and file the transfer with the correct Title Registry.Independence test: The attorney should be free to advise you not to buy, renegotiate terms or withhold funds if a problem appears.
At minimum: the seller's identity and authority; the Certificate of Title; a current certification of the property's legal status; liens, mortgages, litigation or restrictions; the approved cadastral survey and parcel identity; property-tax status; condominium or homeowners' association debt; construction and occupancy permissions; and the seller or developer's corporate documents. For land or older property, your lawyer may recommend an independent surveyor and a physical boundary check. A Constancia Anotada is not the same as an individually surveyed title and deserves extra scrutiny.
A transaction may begin with a reservation agreement, followed by a binding Promise of Sale that sets the price, payment schedule, conditions, default remedies, delivery and closing documents. At closing, the deed of sale is authenticated by a Dominican notary. Taxes and required certificates are obtained, and the transfer package is filed with the Title Registry so a new Certificate of Title can be issued.Key protection: Deposits should be refundable or held back if title, permits, financing or other stated conditions are not satisfied.
The usual transfer tax is 3%. Dominican tax materials describe a 3% tax on real estate transfers. The taxable base and timing should be confirmed for the specific transaction, and an approved incentive or exemption may change the result. Also budget for your attorney, notary and registry charges, certifications, translations, surveys, banking fees and any entity setup. Ask for a written closing statement before signing.
Potentially. The annual Impuesto al Patrimonio Inmobiliario (IPI) applies to individuals at 1% of the aggregate DGII-assessed value above the indexed exemption threshold. For 2026, the official threshold is RD$10,695,494. The official guide states that trusts are generally assessed at 1% of the real estate value. Exemptions and special cases can apply.Important: The threshold is indexed and the DGII value may differ from the purchase price. Recheck both each year.
No - the benefit is project-specific, not location-specific by itself. Tourism Law 158-01 and its regulations can grant incentives to qualifying tourism developments and certain units within them. The exact taxes covered, beneficiaries, start date and remaining term depend on the approved project and its documentation.Verify, do not assume: Obtain the definitive CONFOTUR resolution, confirm that your exact unit is included, and have counsel state in writing which exemptions remain and whether they continue after resale.
Dominican-source rental income can create Dominican tax obligations. The filing method, deductions, withholding and rate depend on whether you own personally or through an entity, your tax status, the tenant or platform, and any applicable incentive. Before advertising the property, have a Dominican accountant map registration, invoicing, withholding and annual-return obligations. Also ask a tax adviser in your home country how to report foreign rental income and claim any available foreign-tax relief.
A taxable capital gain may arise on the difference between the tax-adjusted basis and the sale value. Inflation adjustment, improvements, transaction costs, the seller's identity and any incentive can affect the calculation. A sale can also require tax clearances and updated property records.Keep the file: Preserve the purchase contract, transfer-tax receipt, invoices for capital improvements, financing records and sale expenses. These documents may support the future gain calculation.
Generally possible, but expect bank compliance checks. Keep a clean paper trail from the original inbound transfer through the purchase, rental operations, tax filings and eventual sale. Banks may request contracts, title documents, tax receipts, invoices and source-of-funds or source-of-wealth evidence before processing cross-border transfers.Never improvise payment channels. Use accounts named in the contract and independently verify wire instructions before sending funds.
Sometimes. Dominican banks and some developers finance foreign buyers, but approval, loan-to value, interest rate, currency, term, insurance and documentation vary widely. A lender may request foreign tax returns, bank statements, credit references, proof of income, an appraisal and a larger equity contribution than a resident borrower. Compare the effective cost after mortgage tax and registration, valuation, insurance, currency risk, prepayment terms and legal fees - not just the headline rate
There is no universal best structure. Personal ownership is simpler. A company may help with partners, multiple assets or operations, but brings incorporation, accounting, tax and annual compliance duties. A trust may serve estate or financing goals but has distinct fees and tax treatment.Decide before the reservation deposit. Changing the buyer later can trigger consent, fees, taxes or a new review. Have Dominican legal and tax advisers coordinate with your home-country advisers.
Verify who owns the land; the land's title and liens; zoning and construction permissions; the developer's corporate authority, completed projects and litigation; the construction financing; and any escrow or trust structure. The contract should define the exact unit, plans, finishes, parking, price adjustments, payment milestones, delivery window, grace period, force majeure, inspection, defects, refunds, default remedies, assignment rights and rental-program restrictions.Marketing is not a guarantee. Renderings, projected returns and verbal delivery dates should not replace enforceable contract terms.
